Purpose
This policy explains how Secure Payment works on MyGearMarket. It applies whenever a buyer or seller uses Secure Payment, including direct purchases, accepted offers and accepted counteroffers. It applies in addition to the Terms & Conditions, Privacy Policy, Cookie Policy, Trust & Safety Policy and other platform rules.

MyGearMarket. the online marketplace operated under the MyGearMarket brand.
Secure Payment. the MyGearMarket payment flow that allows eligible buyers and sellers to complete transactions through the platform using Stripe.
Buyer. a user purchasing or attempting to purchase an item through MyGearMarket.
Seller. a user listing or selling an item through MyGearMarket.
Transaction Value. the item price, accepted offer amount or accepted counteroffer amount plus applicable shipping costs.
Secure Payment Fee. the fee charged by MyGearMarket for use of Secure Payment.
Secure Payment is an optional platform payment workflow that enables eligible buyers and sellers to complete transactions through MyGearMarket.
Secure Payment is available only where users satisfy applicable platform, payment-provider, compliance and risk requirements.
Seller verification, Stripe Connect onboarding and payout eligibility requirements may apply.
MyGearMarket does not guarantee that a transaction will complete, that payment will be authorised, that a seller will ship, that a buyer or seller will fulfil their obligations, or that a dispute will be resolved in a particular way.
MyGearMarket provides a marketplace and payment facilitation workflow.
MyGearMarket is not the seller, buyer, manufacturer, dealer, carrier, insurer, authenticator, appraiser or escrow provider of any listed item.
The underlying sale and purchase agreement is concluded directly between buyer and seller. MyGearMarket is not a party to that sale agreement.
MyGearMarket does not inspect, verify, authenticate, appraise, test or guarantee any item, listing, description, provenance, originality, ownership, condition, value, functionality or authenticity.
Secure Payment transactions are processed through Stripe.
By using Secure Payment, users acknowledge that payment processing may be subject to Stripe services, policies, terms, privacy notices and compliance requirements.
Stripe may require identity, business, risk, sanctions, anti-fraud or compliance checks before processing payments or enabling payouts.
Users may be required to agree to or comply with applicable Stripe terms. Relevant Stripe legal information is available at https://stripe.com/legal.
MyGearMarket is not responsible for payment authorisations, declines, reversals, reserves, holds, delays, compliance checks or other decisions made by Stripe, banks, card issuers, payment schemes or payment providers.
Secure Payment requires compliance with applicable eligibility requirements, which may include:
Buyers may be required to maintain both a verified email address and a verified mobile phone number in order to use Secure Payment. Where verification is missing or no longer valid, Secure Payment checkout may be blocked until verification is completed.
Secure Payment is not available for all users, listings, countries, payment methods or transaction types.
MyGearMarket may refuse, restrict, delay, cancel or suspend Secure Payment transactions where required for fraud prevention, payment risk, legal compliance, sanctions screening, platform safety or payment-provider requirements.
A Buyer Secure Payment Fee of 2.5% applies to the buyer when Secure Payment is used.
A Seller Secure Payment Fee of 2.5% applies to the seller when Secure Payment is used.
The Secure Payment Fee is calculated over the full Transaction Value, including the item price, accepted offer amount or accepted counteroffer amount plus applicable shipping costs.
No fee cap applies unless MyGearMarket explicitly states otherwise on the platform or in an updated version of this policy.
MyGearMarket does not add separate payment-method surcharges for specific payment methods. The Secure Payment Fee is a platform service fee and is not a per-method surcharge.
Users may not structure listings, offers, counteroffers or shipping charges to avoid or reduce Secure Payment Fees. MyGearMarket may cancel, restrict, adjust, investigate or suspend transactions that appear to involve fee avoidance.
Shipping costs are set by the seller.
Sellers are responsible for setting realistic shipping costs and for meeting shipping obligations.
When Secure Payment is used, applicable shipping costs are part of the Transaction Value and are included in the Secure Payment Fee calculation.
For every Secure Payment transaction involving shipment, trackable shipping is mandatory and the seller must provide tracking information through the platform.
Shipping insurance is mandatory for every Secure Payment transaction involving shipment. The insurance must cover the full Transaction Value.
The seller must package and ship the item in accordance with the requirements of the selected carrier and the applicable insurer, and must comply with all carrier and insurer conditions.
The seller must retain evidence of shipment, tracking and insurance coverage and provide it on reasonable request.
The seller is responsible for choosing a suitable carrier, uploading accurate tracking information, providing customs information where applicable, complying with shipping restrictions and pursuing any carrier or insurance claims.
If a carrier or insurance claim is denied or reduced because of poor packaging, non-compliance with carrier or insurer requirements, insufficient insurance coverage or incorrect shipping information, the seller remains responsible for the loss.
To the maximum extent permitted by law, MyGearMarket is not responsible for carrier failures, transport damage, loss, theft, delays, customs issues, import duties, incorrect shipping information, packaging failures, denied insurance claims or other shipping-related losses. MyGearMarket is not the carrier, insurer, escrow provider, buyer or seller.
Available payment methods may vary depending on transaction value, buyer location, seller location, currency, Stripe availability, account status, risk checks and payment-provider requirements.
For Transaction Values up to and including EUR 3,000, available payment methods may include credit cards, debit cards, Visa, Mastercard, Apple Pay, Google Pay, PayPal, iDEAL, Bancontact and SEPA Bank Transfer.
For Transaction Values above EUR 3,000, card-based payment methods and PayPal are not available.
Supported bank-based payment methods, including iDEAL, Bancontact and SEPA Bank Transfer, may remain available above EUR 3,000.
For higher-value transactions, MyGearMarket may limit available payment methods to lower-risk or lower-cost payment methods where supported.
MyGearMarket may add, remove, restrict or modify payment methods at any time for operational, risk, compliance, legal or commercial reasons.
To protect users, payment providers and the platform, MyGearMarket applies automated transaction limits and transaction safety controls.
Unless MyGearMarket states otherwise, these controls may include:
These limits and controls may apply to buyers, sellers or both, and may vary based on verification status, account history, transaction history, risk factors, dealer status or other relevant factors.
Where a transaction limit or transaction safety control is triggered, MyGearMarket may automatically block, delay, restrict, refuse or refer a transaction for manual review.
Applicable limits may be updated from time to time for fraud-prevention, security, compliance, operational or platform-safety reasons.
Offers and counteroffers are negotiation tools and do not by themselves complete a sale.
Unless stated otherwise on the platform, offers expire automatically after the period shown on the platform.
Counteroffers must be accepted and paid within the applicable period shown on the platform.
A sale is completed only after MyGearMarket receives confirmation of successful payment processing.
If payment is not completed within the applicable payment window, the offer, counteroffer or accepted offer may expire automatically and the listing may remain or become active again.
Seller payout is subject to successful payment, seller eligibility, Stripe Connect status, tracking upload, fraud checks and platform requirements.
Where shipment is required, seller payout is generally released 48 hours after valid tracking information has been uploaded, provided the payout is otherwise eligible and has not been blocked, delayed or cancelled.
MyGearMarket may delay, restrict or cancel payout where required for fraud prevention, payment risk, account suspension, legal compliance, chargeback risk, payment-provider requirements or suspected policy violations.
MyGearMarket may place a seller payout on a temporary or indefinite administrative hold where necessary for transaction safety reviews, fraud prevention, account review, chargeback monitoring, payment-provider requirements, legal compliance or investigation of suspected misuse.
The duration of any hold may depend on the circumstances of the relevant review, investigation or payment-provider process.
A seller may be required to provide additional information before a held payout becomes eligible for release.
MyGearMarket may process refunds in limited pre-shipment situations before seller payout has been released.

The current cancellation window for missing tracking is 168 hours, or 7 days, after successful payment, unless the platform or an updated policy states otherwise.
Refunds processed through the payment flow are intended only for supported pre-shipment cancellation scenarios.
MyGearMarket does not provide a general refund, return, warranty, compensation, buyer protection or dispute resolution service.
Once tracking has been uploaded or seller payout has been released, MyGearMarket may not be able to process refunds through the platform. Any return, refund or compensation arrangement after shipment must normally be agreed directly between buyer and seller, subject to applicable mandatory consumer law.
Secure Payment Fees are not automatically refundable unless required by law or expressly stated by MyGearMarket.
Transactions arranged outside Secure Payment take place entirely at the buyer’s and seller’s own risk.
MyGearMarket does not process, verify, protect, reverse, reimburse or support payments made outside Secure Payment.
No Secure Payment Fee applies to transactions completed outside Secure Payment.
If a payment is reversed, charged back, disputed, refunded, cancelled, held or otherwise not settled, MyGearMarket may take appropriate action to protect the platform and affected users.
Where MyGearMarket becomes aware of a chargeback, dispute or similar payment-provider claim, the related transaction may automatically be flagged for review and any unreleased seller payout may be placed on administrative hold pending review.
MyGearMarket may monitor chargebacks and payment disputes for fraud-prevention, risk-management, compliance and platform-safety purposes.
MyGearMarket may suspend accounts, restrict payouts, request information, cancel transactions, reverse platform actions, cooperate with Stripe or payment providers, and take other reasonable steps in response to chargebacks, disputes, fraud indicators or payment failures.
Where permitted by applicable law and the relevant payment-provider arrangements, MyGearMarket may offset, recover or seek repayment of amounts relating to chargebacks, reversals, refunds, fraud, payment disputes, payment failures or violations of platform rules. Any such action will depend on the circumstances and may require manual review.
Users must provide accurate and timely information reasonably requested by MyGearMarket or Stripe in connection with payment disputes, chargebacks, verification or compliance checks.
Users may report suspected fraud, abuse, misleading listings, policy violations or other trust and safety concerns through the platform.
MyGearMarket may review reports and may take action where it considers this appropriate, including warnings, listing removal, account restrictions, suspension, permanent restriction, cooperation with payment providers or reporting unlawful conduct to relevant authorities.
Reports are for platform safety and policy review. A report does not create an obligation for MyGearMarket to investigate, mediate or resolve a dispute, and MyGearMarket may not provide individual updates regarding the outcome of a report.
MyGearMarket may refuse, restrict, suspend, cancel or delay any transaction or account where fraud, abuse, illegality, sanctions risk, payment risk, regulatory risk or policy violation is suspected.
MyGearMarket may, but is not obligated to, assist buyers and sellers with transaction-related issues.
Any assistance does not guarantee recovery of funds, recovery of items, successful dispute resolution, reimbursement or a specific outcome.
Providing assistance does not make MyGearMarket a party to the underlying sale agreement and does not create liability for the item, description, seller conduct, buyer conduct, shipping or delivery.
To the maximum extent permitted by law, MyGearMarket is not liable for indirect damages, consequential damages, loss of profit, loss of revenue, loss of opportunity, loss of goodwill, reputational loss, data loss, transport damage, customs issues, payment-provider failures, bank charges, currency conversion costs or actions or omissions of users or third parties.
To the maximum extent permitted by law, MyGearMarket’s total aggregate liability in relation to any Secure Payment transaction shall not exceed the total Secure Payment Fees actually received by MyGearMarket for that specific transaction.
Nothing in this policy excludes liability where such exclusion is not permitted under mandatory applicable law, including mandatory consumer protection rules.
Buyers are responsible for reviewing listings carefully, asking relevant questions before purchase, checking suitability, providing accurate delivery details and completing payment within applicable deadlines.
Sellers are responsible for accurate listings, lawful ownership, item condition, packaging, shipping, dispatch, customs information, communication and compliance with applicable laws.
Users must provide accurate, complete and current information to MyGearMarket, Stripe and other relevant providers.
Users may be required to accept this Secure Payment Policy before completing a Secure Payment transaction.
MyGearMarket may record the user ID, policy version and acceptance timestamp.
Where MyGearMarket publishes a materially updated version of this policy, users may be required to review and accept the updated version before completing future Secure Payment transactions.
MyGearMarket may update this Secure Payment Policy from time to time. The version applicable at the time of a Secure Payment transaction applies to that transaction, unless mandatory law requires otherwise.
This policy is governed by Dutch law, subject to any mandatory consumer protection rules that may apply.
Disputes relating to this policy shall be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise.
